October 19, 2026. On that date, any nicotine e-cigarette not listed on the Pennsylvania Attorney General's ENDS directory becomes contraband in Pennsylvania. It can be seized and destroyed, and you pay the cost of the seizure, transport, storage and destruction on top of the fine.

Directory enforcement begins
The directory was published on June 20, 2026. The law gave every retailer 120 days to sell down or remove unlisted stock. That window closes October 18. From October 19 you may not purchase, sell, offer for sale, or hold in inventory for retail sale any nicotine e-cigarette that is not on the list. Act 57 of 2025, 72 P.S. § 206-I.
ALREADY IN FORCE
Licensed wholesalers only
Since February 20, 2026 a Pennsylvania retailer may buy tobacco products only from a Pennsylvania-licensed wholesaler. Product bought outside that channel is subject to seizure, and your purchase invoices are the proof.
EVERY FEBRUARY
Two licences, not one
Pennsylvania issues two separate retail licences through the Department of Revenue: a Cigarette Dealer licence and a Tobacco Products licence, which is the one that covers vape, e-liquid, pods and devices. Each is $25 per location per year. Both are renewed through myPATH and fees are not prorated.
What you must do
- Hold both Revenue licences for every Pennsylvania location — Cigarette Dealer and Tobacco Products. Vape without the Tobacco Products licence is unlicensed trading.
- Check every nicotine vape SKU against the Attorney General's ENDS directory before October 19 and before every reorder. The directory is updated at least monthly.
- Clear unlisted nicotine vape out before October 19. After that it is contraband, not slow stock.
- Buy only from Pennsylvania-licensed wholesalers and keep the invoice trail.
- Write your store policy down. In Pennsylvania this is not paperwork — see below.
Age and ID
- Minimum age is 21. 18 Pa.C.S. § 6305.
- Pennsylvania has a military exception and Virginia does not. An active, reserve or honourably discharged service member may buy at 18 in Pennsylvania. That same sale is illegal in Virginia. Train your staff on which state they are standing in.
- Pennsylvania says card anyone who appears 25 or younger. Virginia says under 30. A single house rule of card everyone under 30 satisfies both states.
- Pennsylvania law does not list which IDs are acceptable. You have to write your own list into your store policy, or your legal defence fails.
- There is no minimum age in Pennsylvania tobacco law for a clerk, and no on-site supervisor requirement. General child labour law still applies below 14.
The written policy is your defence — this is the big difference from Virginia
Pennsylvania has no state training programme. There is no Pennsylvania equivalent of Virginia's VERT, nothing to enrol in and no certificate to show an inspector. Instead, the law gives you an affirmative defence if you can prove you had all of the following in place. Without them you have no defence at all.
- A written policy that requires carding anyone who appears 25 or younger, lists acceptable ID types, lists what to inspect on the ID, and says an ID missing any of those elements is invalid.
- An established training programme covering federal and state law for every employee who sells tobacco.
- Documentation that each employee was trained and understands the policy — signed and dated.
- Disciplinary sanctions written into the policy for staff who fail to card.
- A conspicuously posted notice that selling to a minor is illegal, that buying as a minor is illegal, and that violators face penalties.
One more thing worth knowing: the defence can be used no more than three times per location in any 24 months. It is not a renewable excuse.

The per-day, per-product structure on a second directory violation is the one that hurts. A single SKU left on a shelf keeps accruing every day it sits there.
Compliance checks
- Run by the Pennsylvania Department of Health, which also inspects on behalf of the FDA.
- The decoy must be at least 14, trained, with parental consent, and may not use the product.
- No more than one check per location every 30 days. If you pass, you get written notice that you passed.
- You are expressly allowed to run your own secret-shopper checks. Do it. It is the cheapest audit you will ever run.
How to check a product
- Open the Attorney General's ENDS directory and search by manufacturer, brand family or type.
- Confirm the exact style, not just the brand. Brand listed does not mean every style is listed.
- Subscribe to the Attorney General's email list for monthly add and remove notices.
- Remember the Attorney General's own position: you are ultimately responsible for making sure what you sell is listed. Ask your supplier for the certification, not a flyer.
