Virginia Vape and Tobacco Compliance
Virginia rules only. Pennsylvania is a different law with different dates and different penalties — do not mix them.
What every Virginia retailer must know

Virginia’s directory only covers products that contain nicotine (Va. Code § 58.1-1021.01). A true 0 mg / nicotine-free vape is not required to be listed, so it can stay on the shelf.
- The box must clearly say 0% / 0 mg / nicotine-free.
- Keep the supplier’s lab certificate (COA) showing 0 mg on file at the store — if a “0%” product tests positive for nicotine, it becomes an unlisted product.
- Tobacco rules still apply: 21+ only, check ID, and sell under your ABC retail tobacco permit.
Not sure if a product has nicotine? Set it aside and ask your manager or your Potomac rep before pulling or selling it.
Virginia’s directory law covers products that contain nicotine. Nicotine analogues are different molecules sold as nicotine alternatives. Under the law as written today they are not “nicotine vapor products,” so they do not have to be on the directory. Potomac keeps them on the shelf in Virginia.
Names you may see on the box: 6-methyl nicotine 6-methylnicotine 6-MN Metatine Nixodine Nixodine-S Imotine nicotine analogue / analog
- The box or the supplier’s paperwork must name the analogue (for example “6-methyl nicotine”). Keep the supplier’s spec sheet or COA showing the active ingredient on file at the store.
- Not the same thing: “synthetic nicotine,” “tobacco-free nicotine (TFN)” and “nic salt” are all real nicotine — those products MUST be on the list.
- Tobacco rules still apply: 21+ only, check ID, ABC retail tobacco permit.
- This is a gray area and can change — a new law, Virginia ABC (which takes over vape enforcement on October 1, 2026) or FDA action could close it. If Potomac tells you to pull a product, pull it.

The directory is being enforced
Since April 1, 2026, only nicotine vapor products listed on the Virginia Attorney General's directory may be sold in Virginia. If it is not on the list, it cannot be on your shelf. Va. Code §§ 59.1-293.15 through 59.1-293.22.
You need an ABC retail tobacco permit
Every Virginia location selling tobacco, nicotine vapor or hemp products must hold a Virginia ABC retail tobacco permit. Selling without one after this date can bring misdemeanor criminal charges. Application fee is $400 if you do not hold an ABC alcohol licence, $300 if you do, plus $15 per background check for every person owning 10% or more. Title 4.1, Chapter 2, Article 4.
Penalties go up sharply
The fine for selling a product that is not on the directory rises to at least $5,000 per product, and the underage-sale ladder becomes $1,000, then $5,000, then $10,000 — with your permit at risk. Certification reopens the same day at $5,000 per product, $2,500 to recertify each year.
What you must do
- Apply for your ABC retail tobacco permit for every Virginia location. The applicant must be 21 or older. Locations selling only cigars or pipe tobacco are exempt.
- Check every vape SKU against the Virginia directory before you buy it and before you put it on the shelf.
- Pull anything not listed. Do not sell it, do not discount it, take it off the sales floor.
- Keep your invoices and sales records 3 years. Va. Code § 59.1-293.19 and § 4.1-253. Failure is a Class 2 misdemeanor, and refusing an inspection costs $1,000 a day.
- Train your staff and keep the record. Va. Code § 59.1-293.13 requires you to attest that you have educated employees. ABC's free online VERT course satisfies that attestation.
Age and ID
- You may not sell any nicotine or tobacco product to anyone under 21. Virginia has no military exception.
- You must examine government-issued photo ID from anyone who appears to be under 30. This is a requirement, not a courtesy. Va. Code § 4.1-359.
- There is no minimum age in Virginia tobacco law for an employee to work in a tobacco-only shop, and no requirement that a 21-or-over manager be physically present. Those rules apply to ABC alcohol licensees, not to tobacco permit holders.
- Two things still apply: general Virginia child labour law restricts employing anyone under 16, and the permit holder is liable for what employees do. The fine lands on the store.
- Only the permit applicant must be 21 or older.
What it costs if you get it wrong

How to check a product in 30 seconds
- Open the Virginia Attorney General's nicotine vapor product directory.
- Search the brand family, not the flavour. Then confirm the exact style and nicotine strength.
- If the brand is there but your exact style is not, it is not approved.
- Ask your supplier for the certification, not a flyer. A vendor flyer saying “registered in Virginia” is not proof of anything.

Does a manager have to be in the store?
Virginia's designated-manager rule is 3VAC5-50-40. It sits in Title 3 of the Virginia Administrative Code, which is titled Alcoholic Beverages, and it binds ABC alcohol licensees. It says three things:
- An alcohol licensee must have a designated manager present and in actual charge of the business at any time the establishment is open.
- That manager's name must be kept posted in a conspicuous place, in letters not less than one inch, while they are in charge.
- An alcohol licensee may not knowingly permit a person younger than 21 to act as designated manager.
None of the three applies to a tobacco-only store. If you sell no alcohol you do not need a manager on site, you do not post a manager's name on the wall, and your clerk does not have to be 21. What you do need is the retail tobacco permit under Title 4.1, Chapter 2, Article 4, and staff who card everyone who appears under 30 under Va. Code § 4.1-359.
The day you add alcohol to that location, all three duties switch on.
Check a product before you stock it
Every nicotine vapor product on the Virginia Attorney General’s directory is on one page — photo, flavor, strength and UPC, filtered by brand or category, and marked when Potomac carries it. If a product is not on that list, it cannot be sold in Virginia.
