Not covered by the VA directory

Virginia’s directory law covers products that contain nicotine. Under the law as written today, an analogue product is not on that list and isn’t required to be.

• It is still a retail tobacco product: sell under your ABC tobacco permit, 21+ only.
• Keep the supplier’s COA on file at the store.

The same-brand rule

Pennsylvania’s directory (Act 57 of 2025) covers e-cigarettes that contain nicotine. A non-nicotine product does not need to be listed — unless it shares a brand name with an e-cigarette that contains nicotine.

“The term includes an electronic cigarette that bears the same brand name as an electronic cigarette determined to contain nicotine by the department or Attorney General.”— 72 P.S. § 202-I, definition of “electronic cigarette that contains nicotine” (Act 57 of 2025)

• Before stocking a line in PA, confirm the brand has no nicotine version.
• A product labeled, advertised or marketed as containing nicotine is covered, whatever is inside.
• Lines marked ✓ Never sold as nicotine* are from brands with no nicotine version found: Geek Labs, Hookah Labs, Mi-Pod, Parfflo.
• Keep the COA on file, 21+ only.

*Potomac brand check, October 2026: no nicotine product found under that brand name on brand sites, major retailers, or the VA and PA directories. Get the supplier’s written confirmation and COA before selling in Pennsylvania.
