Potomac Distro complies with federal laws such as the PACT Act for shipping and reporting of tobacco/vape products. We report and collect applicable taxes as required by law in certain jurisdictions. Any taxes, duties, or compliance filings not handled by Potomac Distro are the buyer’s responsibility. If a particular state or locality imposes additional requirements (e.g. licensing, excise taxes, or product restrictions), the buyer must ensure they fulfill those obligations. Potomac Distro is not liable for any consequences (seizures, fines, etc.) resulting from shipments requested by the buyer to jurisdictions where the products are restricted or prohibited.

3. Account Registration & Security

To access wholesale pricing and place orders, you must create an account on our Site. You agree to provide accurate, current, and complete information during registration and to update such information as needed. Each business is generally allowed one account; creating multiple accounts for the same entity or using false identities is prohibited. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Do not share your account with unauthorized persons. If you suspect any unauthorized use of your account or a security breach, you must notify us immediately. Potomac Distro is not liable for any loss or damage arising from your failure to safeguard your account information.

We reserve the right to approve or reject account registrations at our discretion, especially if required documentation (e.g. business license) is not provided or if we cannot verify your business credentials. Accounts that are inactive or found to be violating our terms may be suspended or terminated without prior notice.

4. Pricing, Orders, and Payment

All prices on our Site are listed in U.S. Dollars and are wholesale prices intended for B2B purchases. Prices are subject to change without notice. We strive to ensure accuracy in product descriptions and pricing, but errors may occur. Potomac Distro reserves the right to modify or correct pricing errors and to cancel or refuse any order with incorrect pricing (with a full refund for any amounts paid).

By placing an order, you are making an offer to purchase the selected products. Orders are not binding upon Potomac Distro until we accept and process them. We reserve the right to refuse any order or limit quantities at our sole discretion. For example, we may limit large orders of scarce items, or refuse orders that appear to be shipping to residential addresses or unverified locations (since we sell only to businesses). If we refuse or cancel an order, we will attempt to notify you using the contact information provided in your account.

Payment for all orders must be made at the time of ordering, using the payment methods we support. Currently, Potomac Distro accepts major credit cards and other electronic payments. All credit card transactions are processed securely via Shift4, our third-party payment processor, which is PCI-compliant and ensures your payment details are handled safely. We do not store full credit card numbers on our servers; payment information is transmitted securely to Shift4 for processing. (You can review Shift4’s privacy/security policy on their website.) If a payment is declined or if there is a payment dispute/chargeback, Potomac Distro reserves the right to halt fulfillment of the order and to investigate the issue. We may contact you for additional verification if needed.

5. Shipping & Delivery

Shipping Regions: Potomac Distro currently ships orders only within the United States (including U.S. states and the District of Columbia). We do not offer international shipping. Furthermore, we cannot ship to P.O. boxes or APO/FPO/DPO addresses, as our products require adult signature upon delivery. All orders require an adult (21+) signature at the time of delivery, without exception. We primarily ship via recognized carriers (e.g. UPS, FedEx, USPS or specialized carriers compliant with PACT Act) that offer age-verified delivery services. The shipping carrier may require valid government photo ID from the recipient at delivery.

Order Processing: We typically process and ship orders within 1–2 business days after payment is received. Our warehouse operates Monday through Friday (excluding holidays). Orders placed after our daily cutoff or on weekends/holidays will begin processing on the next business day. While we strive for prompt shipping, we do not guarantee specific delivery dates, as transit times depend on the carrier and destination. Once shipped, most domestic orders arrive within a few days (usually 2–7 business days depending on distance from our Virginia location). During peak seasons or unexpected events (weather, carrier delays), delivery may take longer. Potomac Distro is not liable for delays once the package is in transit, as these are outside our control.

Shipping Fees: Shipping charges (if any) will be calculated and shown at checkout based on your order weight, size, destination, and chosen shipping method. We may offer free or discounted shipping for orders that meet certain value thresholds or as part of promotions – see our Shipping Information page or announcements for details. Any such offers are subject to change and apply to qualifying orders in the contiguous US unless stated otherwise.

Insurance & Risk of Loss: All shipments are insured or protected in case of loss or damage in transit. If your order is lost by the carrier or arrives damaged, please contact us within 3 business days of the delivery date to report the issue. We will assist in filing a claim with the carrier or provide a solution (reshipment or refund) as appropriate. Note: If you provide an incorrect or undeliverable address, or if delivery is refused without authorization, you will be responsible for additional shipping fees to re-send the package or for any return-to-sender fees.

Once a package is delivered to the correct address and signed for, ownership and risk transfer to the buyer. Please inspect deliveries promptly. If you notice any shortage or exterior damage, note it with the carrier upon delivery if possible, and contact us immediately so we can address it. For freight or larger shipments, any visible damage should be noted on the Bill of Lading or delivery receipt (e.g. “box damaged”) and reported to us right away.

6. Returns & Warranty Policy

Potomac Distro wants you to be satisfied with your purchase. However, as a wholesale supplier of consumable and personal-use products, we have specific return guidelines. All sales are generally considered final, but we do allow returns or exchanges under certain conditions as outlined below (in accordance with our Return Policy page, which is incorporated by reference):

  • Defective or DOA Products: If you receive products that are defective, damaged, or Dead on Arrival, you may request a return or exchange within 30 days of delivery. This 30-Day window applies only to products with manufacturer defects or damage in transit, not to ordinary wear and tear or user damage. We may ask for documentation such as photos or a description of the issue to validate the defect. Eligible defective items will be exchanged for a new unit or a credit/refund, at our discretion. Example: a device that fails to power on out of the box, or a product that arrived broken, would qualify as DOA.
  • Unopened Merchandise (Buyer’s Remorse): If you ordered an item by mistake or no longer need it, and the product remains unopened and in brand-new condition, you may contact us to return it within 30 days of purchase for a refund or credit. These non-defective returns are subject to a restocking fee of up to 20% of the product price, and the original shipping cost (if any) will not be refunded. You will also be responsible for the return shipping cost. We only accept such returns if the items are unused, sealed, and in re-sellable condition with all original packaging intact. After we receive and inspect the returned item, we will issue a refund (minus fees) or store credit within 5–7 business days. Please note: If any “unopened” item is found to have been used or the seal broken, the return will be rejected and the item will be sent back to you at your expense.
  • Non-Returnable Items: Due to health, safety, and regulatory reasons, certain product categories cannot be returned or exchanged once sold (except if defective on arrival). Opened or used products of any kind are not returnable. In particular, we cannot accept returns on consumable or sanitary items such as: e-liquids or vape juices (opened or unopened), cartridges or pods (opened), coils and atomizers, drip tips or mouthpieces, replacement coils or wick/cotton, batteries that have been charged/used, or any item that has been visibly used or tampered with. E-liquids and other consumables are final sale, as taste/preference is subjective and they cannot be resold once shipped. Additionally, any free promotional items or clearance sale items are non-returnable. Please be sure of your purchase before ordering these product types.
  • Return Procedure: To initiate a return or exchange, you must contact our Customer Support at info@potomacdistro.com (or call (855) 777-7580) within the allowed return window. We will provide you with return instructions and a Return Merchandise Authorization (RMA) if the item is eligible. Do not send back items without first obtaining authorization. In your return request, include your order number, the item(s) being returned, and the reason (e.g. defect description, or if it’s an unopened return). For defective/damaged claims, providing clear photos of the product and the packaging is very helpful and may be required for verification. Once we approve your return, you will need to ship the item back to us at the address provided (unless we provide a prepaid return label in certain cases of defective products). We recommend using a trackable shipping service and packing the item securely in its original packaging.
  • Inspection and Outcome: Upon receiving your return, our team will inspect the merchandise. If the product is confirmed defective or the return is approved, we will process a replacement shipment or issue a refund/credit as agreed. For refunds, we will credit the original payment method (or issue store credit) typically within 5–10 business days. If the returned item is found not to be defective (for example, if it powers on normally upon testing) or if it shows signs of use/misuse that were not reported, we reserve the right to deny the return. In such cases, the item will be sent back to you, and you will be responsible for any return shipping costs. We are not responsible for returns lost or damaged in transit to us, so please ensure proper packaging.
  • 30-Day Limit: Except as expressly allowed above, no returns or exchanges will be accepted after 30 days from delivery. This timeframe is firm. Additionally, Potomac Distro does not offer product warranties beyond this return period, except where a manufacturer’s warranty may apply and must be handled directly with the manufacturer. For any product issues outside our return window, please contact the manufacturer for support.

12. Governing Law & Dispute Resolution

These Terms and any disputes arising from your use of the Site or purchase of products are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.

In the event of any dispute or claim between you and Potomac Distro, both parties agree to attempt to resolve it amicably through informal negotiation for at least 30 days. If a resolution cannot be reached, you agree that exclusive jurisdiction and venue for any legal action shall be in the state or federal courts located in Virginia. Specifically, disputes will be litigated in the courts of the State of Virginia (or the U.S. District Court covering our business location), and both parties consent to personal jurisdiction in those courts. You agree to waive any objections based on inconvenient forum or jurisdiction for these courts. (If you are a Potomac Distro customer located outside Virginia, please be aware that by agreeing to these Terms, you are voluntarily subjecting yourself to the jurisdiction of Virginia courts for dispute resolution.)
